1. Acceptance of Terms
By accessing or using the ClearStack website at clear-stack.com or purchasing any of our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all visitors, clients, and others who access or use our services.
2. Services
ClearStack provides the following services:
- Website design and development for local service businesses
- Sales funnel design and development for coaches, consultants, and course creators
- Google Business profile setup and optimization
- Missed call text-back and lead automation setup
- Review generation automation
- Ongoing hosting, maintenance, and support on a monthly retainer basis
- Free AI Business Audit reports
Service details, deliverables, and timelines are confirmed at the time of purchase.
3. Payment Terms
All setup fees are due at the time of purchase and processed through Stripe. Monthly retainer fees are billed automatically on a recurring basis. Annual plan fees are billed in full at the start of each annual period. All payments are in US dollars. Prices are subject to change with 30 days written notice to existing clients.
4. Refund Policy
Setup fees are non-refundable once work has begun. If work has not yet started, a full refund may be requested within 48 hours of purchase. Monthly retainer fees are non-refundable for the current billing period but you may cancel at any time to stop future charges. If your website experiences downtime exceeding 4 consecutive hours in a given month, that month's retainer fee will be credited to your account.
5. Delivery Timelines
Estimated delivery timelines are as follows:
- Standard Setup: 10 to 12 business days from receipt of all required information
- Priority Setup: 3 to 4 business days from receipt of all required information
- VIP Setup: 24 hours from receipt of all required information
- Funnel Builds: 7 to 14 business days depending on the package selected
Timelines begin once the client has completed the onboarding form and provided all necessary content, assets, and approvals. Delays caused by the client will extend the delivery timeline accordingly.
6. Client Responsibilities
To allow us to deliver your project on time, you agree to:
- Complete the onboarding form promptly after purchase
- Provide all required content, images, and business information in a timely manner
- Review and provide feedback on deliverables within 5 business days of submission
- Ensure all content you provide does not infringe on any third-party intellectual property rights
7. Intellectual Property
Upon full payment of all applicable fees, you own the content and design of your delivered website or funnel. ClearStack retains the right to display completed work in our portfolio unless you request otherwise in writing. All proprietary tools, systems, automation templates, and processes used to build your project remain the intellectual property of ClearStack.
8. Growth Share Program
Participation in the ClearStack Growth Share program is subject to a separate Growth Share Agreement provided at the time of acceptance into the program. The revenue share arrangement, reporting obligations, payment terms, and program rules are outlined in that agreement. ClearStack reserves the right to accept or decline any Growth Share application at its sole discretion.
9. Limitation of Liability
ClearStack's total liability for any claim arising out of or related to these terms or our services shall not exceed the total amount paid by you to ClearStack in the 3 months preceding the claim. ClearStack is not liable for any indirect, incidental, special, or consequential damages including but not limited to lost revenue, lost profits, or loss of data.
10. Warranties and Disclaimers
ClearStack warrants that our services will be performed in a professional and workmanlike manner. We do not guarantee specific results such as Google ranking positions, lead volume, or revenue increases, as these depend on factors outside our control including market conditions, competition, algorithm changes, and client responsiveness. Our services are provided with no other warranties, express or implied.
11. Termination
Either party may terminate the monthly retainer service at any time with written notice. Termination takes effect at the end of the current billing period. Upon termination, we will transfer all website files and credentials to you within 10 business days upon request. ClearStack reserves the right to terminate service immediately if a client violates these terms or engages in abusive, threatening, or unlawful behavior toward our team.
12. Governing Law
These Terms of Service are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Broward County, Florida.
13. Changes to These Terms
We may update these Terms of Service from time to time. We will notify existing clients of material changes via email with at least 14 days notice before the changes take effect. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
